Personal Injury and Wrongful Death
People who are injured through the fault, negligence, carelessness or recklessness of others are entitled by law to be compensated for their injuries and damages, which can include medical bills, past and future pain and suffering, lost wages, lost quality of life, and more. At Cardenas Law Firm, our number one job is to help secure the compensation you deserve if you have been injured or a loved one has suffered a wrongful death by the fault of another.
Do I have a case?
The three parts of a personal injury case.
Victims of injury often wonder: Do I have a case?
Generally speaking, in order to win a personal injury case three legal “elements” must exist:
- A legal duty between the defendant (the one responsible for the wrongdoing) and the plaintiff (the victim)
- A breach of that duty by the defendant
- Damage to the plaintiff because of that breach
In other words, the defendant was supposed to do something a certain way, but didn’t. As a result, the plaintiff (the injured person) got hurt. A driver was supposed to stop at a stop sign, but ran through it instead and hit the victim, causing injuries. A doctor was supposed to perform surgery on a knee, but misinterpreted the charts and amputated the leg instead, causing the victim a lifetime of complications. A ship owner should have replaced the old, frayed cables but did not, and as a result the cables snapped and dropped a load of cargo on the victim, paralyzing him. The toy manufacturer was supposed to make sure small parts could not be broken or bitten off, but did not, and an infant choked to death as a result. This basic “three element” formula applies to other types of “injury” as well. Injury to property or land: The factory was supposed to safely dispose of its chemicals, but instead buried them on the land that was leased from you – as a result the land is now uninhabitable, its value substantially less, and the cleanup will cost a fortune. Injury to business: A contractor or architect was supposed to complete the new store location by a certain date, but years later the job is still not finished – it will now cost a fortune to have the botched job corrected or finished, and the contractor’s failure to finish on time has cost the owner years in lost business or tax incentives.

When you lose a loved one due to the fault of another, you may be entitled to compensation.
The law gives families of wrongful death victims the right to seek compensation. This body of law is designed to compensate families not only for their financial loss, but also for emotional loss, for example – compensation for a child who will never be able to enjoy growing up with their father, or compensation for a wife who has forever lost the companionship of her husband of the past fifteen years. Whoever wrongfully caused the death of your loved one may be forced to pay damages for lost wages and benefits, loss of companionship, and the emotional pain and suffering caused by the fatal accident. At the Baton Rouge based law firm of Cardenas Law Firm our lawyers are absolutely committed to helping families find some measure of justice for the loss of their loved one.
Fighting for you and your family when you have suffered a wrongful death.
Our attorneys understand that seeking compensation will not undo the damage that an act of negligence, carelessness or recklessness has caused. No amount of money can ever truly compensate for the death of a loved one, or bring that person back. But we also know that the grief from loss of a loved one is often accompanied by very real and serious financial hardships resulting from the loss. While money can’t bring back your loved one, but a financial recovery can help you and your children by covering current and future expenses. At Cardenas Law Firm we fight for families to help them secure compensation for all kinds of wrongful death cases, including fatal car accidents and truck accidents, medical malpractice, offshore accidents, railroad accidents, fatal chemical exposures, and more. If you have recently suffered the wrongful death of a loved one, we pledge our best effort to secure for you and your family the full support you are entitled to receive under the law.
You need to remember that in Louisiana, you have one year from the date of the death to file a wrongful death claim after a fatal accident. Our firm also brings wrongful death cases in Texas. Also, if your loved one had a personal injury suit underway before he or she died, you or another family member may be able to inherit that claim. You may be able to complete the case and receive the compensation that was due to your loved family member, for the benefit of all or some of the surviving family members.
We are here for you, and will stay in touch with you.
We give every wrongful death case the personal attention it deserves. As your attorneys, we will work closely with you, making ourselves available and communicating with you regularly to explain the details of your case in a down-to-earth way that is easy to understand. We can appreciate and understand the frustration of people who complain to us that in previous experiences with the legal system they could never seem to reach their attorney. Our goal is always to return our clients’ phone calls and reply to clients’ e-mails promptly. In your time of grief, you don’t need any added worry or frustration trying to reach your lawyer to find out what’s going on. We do our best to stay in touch and to help you understand the sometimes confusing and lengthy legal process to you as your case moves forward.

Payment for burns and injuries resulting from chemical exposure.
Chemical exposure or burn injuries can occur in a workplace because of industrial accidents, but can also occur in any number of other ways – from pollution, from far-away release of toxins, from contamination of water, etc. Often times, injuries resulting from chemical exposure are not necessarily discovered right away. A pregnant mother can be exposed to chemicals from a local industrial plant, causing serious birth defects. Mold or asbestos can cause cancer, disease, and other exposure-related health effects such as mental illness or birth defects.
The law firm of Cardenas Law Firm handles serious chemical exposure and burn injuries of all types, for victims who have been harmed by the negligence of others. We will also represent the families of loved ones killed in fatal plant explosions and chemical exposure accidents.
We have the resources to investigate what caused your chemical or burn injury.
Industrial sites link to industrial accidents are often inundated with chemicals, but when the chemicals are not properly regulated in the workplace, workers are left to deal with serious health implications. Solvents, asbestos, lead and mercury are all examples of potentially toxic chemicals that can cause permanent damage to workers’ health.
While it is sometimes clear what chemical has caused your injury, other times it is difficult to pinpoint the precise reason for injuries or illness, or how exactly the exposure occurred. We will investigate your chemical exposure to get to the root of your health issues. Even though the exposure may have occurred several years ago, we can thoroughly research and investigate your case for you, and we will fight to get you justice.
Burn injuries last a lifetime.
Serious burn injuries or fire injuries usually cause long-lasting scars, disfigurement and permanent nerve damage. These kinds of injury also often require long-term (even lifetime) medical treatment and care. Whether the burn injuries stemmed from an industrial accident or from a car accident, truck accident or other road accident we at Cardenas Law Firm can efficiently handle the complex legal questions involved and seek proper compensation for your injuries, including medical bills, pain and suffering, loss of enjoyment of life, and lost past and future earnings.
